SIZESWEEP TERMS OF USE

October 2026

1. Applicability

1.1 These Terms govern your installation and use of SizeSweep and its updates. For a paid licence, the effective date is the purchase date shown on your receipt.

1.2 Read these Terms before accepting them. Acceptance requires an affirmative action, such as selecting an agreement checkbox. If you do not agree, cancel installation or activation.

1.3 These Terms govern the software licence. Your purchase is also subject to the product description, checkout information and applicable seller terms supplied with your order.

1.4 Nothing in these Terms excludes or restricts rights, obligations or remedies that applicable law does not permit us to exclude or restrict. Those protections prevail over every other provision.

2. Definitions

2.1 "SizeSynth", "we", "us" and "our" mean SizeSynth, trading as SizeSynth.com, the supplier and licensor identified in section 20.

2.2 "Software" means SizeSweep and the SizeSweep updates covered by your licence.

2.3 "Named licensee" means the one individual to whom a licence is granted. "You" and "your" refer to that individual.

2.4 A "licence unit" is one paid SizeSweep licence unit for one named individual, permitting activation on two computers at the same time. Additional units add two computer slots each for that same individual.

2.5 "Account" means the SizeSynth account that owns your licence. "Your material" means your own lawful audio, projects and resulting output. "Website" means https://sizesynth.com.

3. The Software

3.1 SizeSweep is a Windows 64-bit VST3 audio filter plugin with LOW, HIGH, RES and MIX controls, mono/stereo processing and host automation.

3.2 LOW controls high-pass filtering, HIGH controls low-pass filtering, RES controls resonance and MIX blends the original and processed audio. SizeSweep processes audio supplied through a compatible host.

3.3 The licence covers the Windows VST3 product. A macOS version is included only where expressly offered with the purchase. Supported release and tested host compatibility are stated in the product offer.

3.4 Resonance can increase output levels. SizeSweep does not guarantee a particular artistic result, income or commercial outcome.

4. Licence Grant

4.1 A confirmed purchase grants one named individual a limited, non-exclusive, non-transferable lifetime right to install and use SizeSweep for lawful personal and commercial audio work under these Terms. The right is revocable only on the lawful breach, refund or revocation grounds in section 15.

4.2 Each paid licence unit permits activation on two computers at the same time. Unlimited plugin instances are permitted on a licensed computer. Additional units add two computer slots each for the same individual.

4.3 Employer payment does not authorise shared accounts, team use or additional users. Every other user requires a separate licence and account.

4.4 The licence covers SizeSweep only, including future SizeSweep updates. It does not grant access to other SizeSynth.com products.

4.5 The lifetime licence has no recurring subscription or renewal charge. Offline authorisation remains subject to sections 8 and 9.

4.6 Any complimentary licence issued by SizeSynth.com is a separate grant to a named recipient under its stated conditions. It does not transfer an existing licence or create a right to further complimentary licences.

5. Permitted Use and Your Audio

5.1 The named licensee may use SizeSweep for personal and commercial audio processing on activated computers within the purchased allowance. Commercial distribution of the resulting audio is permitted.

5.2 You must hold the rights and permissions required for the audio and other material you use. Your own lawful audio and project output remains yours.

5.3 You may make the copies needed for authorised installation, execution and backup, use permitted configuration and settings, and install authorised updates.

6. Restrictions

6.1 Except for the permissions in these Terms, express permission from SizeSynth.com, mandatory law or an applicable third-party component licence, you must not: (a) copy or modify proprietary software, or create unauthorised derivative software; (b) reverse engineer, decompile or disassemble the proprietary software; (c) sell, resell, gift, transfer, share, rent or sublicense an existing licence or access to the Software; (d) redistribute proprietary copies or make the Software or your account available to another person; (e) share account credentials or activation keys, or use another person's credentials; (f) exceed the purchased computer allowance or allow another person to use your licence; or (g) bypass, tamper with or defeat activation, licence validation or computer limits.

6.2 Applicable statutory backup, observation, study, testing and interoperability rights are preserved within their legal conditions.

6.3 Rights granted by independently licensed third-party components remain unaffected. Included third-party licence notices govern their respective components.

7. Accounts and Security

7.1 You must use the account that owns your licence and remain within its purchased computer allowance. Release an existing activation before exceeding that allowance. For a lost or inaccessible computer, use account device management where available.

7.2 You must not share account credentials or use another person's credentials. You may report suspected misuse through the contact details in section 20. Do not disclose passwords.

7.3 Changing your own email address or replacing your computer is account management, not a licence transfer.

7.4 Refreshing expired offline authorisation retains the existing licence and computer allocation. It does not add computer capacity or require another purchase.

7.5 Signing out of an account, releasing a computer, closing an account and cancelling a purchase are distinct actions. Account closure alone does not end valid lifetime licences or remove the minimum linkage needed to preserve them. Licence restrictions are governed by section 15 and record retention by section 14.

8. Activation and Internet Access

8.1 Installation does not require a paid activation. Installer acceptance does not itself purchase or activate a licence, or establish the checkout consent described in section 12.

8.2 Initial sign-in and activation require internet access. The purchasing account must be verified, its SizeSweep entitlement confirmed and the licence terms affirmatively accepted before activation completes. Activation is automatic after the required checks; you do not need to enter a licence reference or activation key manually.

8.3 During online use, licence validation runs automatically on startup, reconnection and periodically, at least daily. Successful renewal before expiry does not require repeated manual sign-in.

8.4 Successful validation supplies signed offline authorisation for SizeSweep and the activated computer for up to 30 days. Its signed expiry determines whether a new licensed instance can open.

8.5 Opening the app, local changes, a failed refresh or a service outage do not extend that expiry. You must not manipulate the system clock, device information or licence data to evade validation or extend authorisation.

8.6 Offline use with seven days or less remaining produces a dismissible reminder to reconnect. If SizeSweep is closed when that period starts, the reminder appears on the next offline use within the period. Instances coordinate reminders without interrupting playback or audio tails.

8.7 Successful validation renews authorisation and clears the reminder. An unsuccessful refresh leaves the original expiry unchanged.

9. Expiry and Existing Sessions

9.1 An instance opened with valid offline authorisation remains usable until closed, including playback and renders, if that authorisation expires during use. Ordinary expiry or a failed background refresh does not interrupt that instance.

9.2 This permission ends when the instance is closed or unloaded. It does not authorise another instance. Showing or hiding the editor does not create a new instance. Stopping and restarting transport does not create a new instance where the same plugin instance remains loaded.

9.3 After authorisation expires, opening or reloading an instance requires successful owner sign-in and refresh for SizeSweep and that computer. A cancelled or failed refresh does not authorise the new opening. Ordinary expiry does not require another purchase.

9.4 Reliable, current confirmation of a refund withdrawal or revocation is separate from ordinary expiry and is governed by section 15. Network or sign-in errors do not themselves establish such confirmation.

10. Installation, Compatibility and Updates

10.1 SizeSweep requires Windows 10 or later, a compatible 64-bit VST3 host and a computer meeting that host's requirements. Internet access is required for activation and refresh. The installer supplies the required Microsoft runtime where needed.

10.2 Supported compatibility and specific support commitments are stated in the product offer. We do not promise compatibility with every third-party system.

10.3 The lifetime purchase includes future SizeSweep updates. SizeSynth.com provides ongoing support and service continuity. Update and download instructions are supplied through the Website.

10.4 SizeSynth.com may email relevant update and service information about SizeSweep, including genuine software, security, compatibility, licensing and support information needed for access. This does not require newsletters, paid-upgrade advertising or other-product offers. Optional other-product marketing remains separate, and declining or withdrawing it does not affect purchase or lawful access.

10.5 If SizeSynth.com ceases trading, it will remove licence requirements for existing purchases so customers can continue using their software.

11. Orders, Payment and Delivery

11.1 The standard launch price is USD 19.99 per licence unit, paid once and including applicable taxes, with no launch discount or additional tax on top. The product, quantity and total payable are shown before payment.

11.2 Verified payment makes the SizeSweep licence and purchased computer allowance available to the owning account automatically.

11.3 Supply of the installer and purchased access follows the delivery arrangements stated in the product offer and checkout. Payment or acceptance alone is not confirmation that delivery has occurred. Retain the purchase receipt and accepted terms.

11.4 For a Paddle purchase, the Paddle reseller identified at checkout and on the receipt is the seller. The Paddle Buyer Terms govern the sale; these Terms govern the SizeSweep licence and use. Paddle Buyer Terms: https://www.paddle.com/legal/buyer-terms.

12. Cancellation and Refunds

12.1 Cancellation and refunds are governed by applicable consumer law and, for Paddle purchases, the applicable Paddle sale terms. UK consumers normally have a 14-day cancellation period beginning the day after the contract is made.

12.2 For immediate digital supply, the required express consent and acknowledgement of loss of the cancellation right must be obtained before supply starts, with the required durable confirmation. The cancellation right ends on commencement of supply where those requirements are met. Installer agreement is separate from that checkout consent and confirmation.

12.3 After cancellation rights have lawfully ended, discretionary cancellation is exceptional. Rights concerning faulty or misdescribed digital content and applicable repair, replacement or price reduction remain unaffected. A confirmed full refund removing the last valid SizeSweep licence ends licensed access as described in section 15.

12.4 Cancellation or refund requests should include the purchase reference and be sent to Contact@sizesynth.com. For Paddle purchases, the receipt's payment support route or https://paddle.net is also available.

12.5 You may use the following cancellation form, but it is not compulsory:

To: SizeSynth.com, Contact@sizesynth.com I give notice that I cancel my contract for the supply of SizeSweep. Order date: Purchase reference: Customer name: Customer address: Account email: Date: Signature, only if submitted on paper:

13. Intellectual Property

13.1 SizeSweep is licensed, not sold. SizeSynth.com and its licensors retain all rights, title and interest in the proprietary software, code, interface, graphics, documentation and updates. The licence does not transfer ownership of that material. All rights not expressly granted are reserved.

13.2 Your ownership of your own lawful audio and project output is preserved by section 5. Rights granted by independently licensed third-party components remain unaffected, as set out in section 6.

14. Privacy and Records

14.1 Personal information, retention and privacy rights are governed by the shared Privacy Policy: https://sizesynth.com/privacy/.

14.2 Account, purchase, licence and device information is used to validate licences, computer allowances and offline authorisation. The Windows client keeps protected device, licence, activation and clock information. Sign-in uses the credentials and tokens required for account access.

14.3 Necessary identity, purchase and licence linkage and relevant substantiated dispute or legal-duty records can survive closure or revocation, subject to justified purpose, necessity and rights. This is not blanket indefinite retention.

14.4 Account details are retained for the life of the account and 12 months after closure. Licence records are retained for the life of the valid licence and 12 months after lawful end. Minimum linkage necessary for valid lifetime entitlements survives account closure.

14.5 Under the shared Privacy Policy, purchase and payment records are retained for 6 years from purchase, longer where statutory tax or accounting duties require.

14.6 Substantiated breach, suspension and related appeal records are retained for 6 years from the decision, longer only for minimum evidence justified by an unresolved dispute or scoped legal hold.

14.7 Retention is reviewed at least annually. Information no longer needed is deleted or anonymised, subject to legal duties and justified holds. The shared Privacy Policy provides the full schedule, safeguards and privacy rights.

14.8 Privacy acknowledgement is not marketing permission or a substitute for required licence or immediate-supply choices. Contact Contact@sizesynth.com for privacy requests or complaints. Do not send passwords or payment-card details. Applicable legal response deadlines and lawful extensions govern. A licence appeal does not replace statutory privacy or consumer requests.

15. Suspension, Revocation and Termination

15.1 SizeSynth.com may terminate the affected licence for a material breach where termination is lawful and proportionate. The affected licence and reasons will be identified, with notice and a reasonable opportunity to remedy a remediable breach where required by law and the circumstances.

15.2 When reliable, current confirmation establishes that a full refund has removed the last valid SizeSweep licence, licensed processing stops immediately in affected open instances and new licensed openings are blocked.

15.3 A confirmed sharing or resale revocation likewise stops affected licensed processing when confirmation is received and blocks new openings under that licence.

15.4 Following lawful termination, you must stop using the affected proprietary software and remove proprietary copies you are no longer authorised to keep. This obligation does not extend to your own audio or projects, independently licensed components, or records and copies you are legally entitled to retain for rights, remedies or evidence.

15.5 Restrictions take effect when SizeSweep receives confirmation. A pending refund, network or sign-in error, or offline status is not confirmation. Other products, remaining valid SizeSweep licence units and accrued rights are unaffected.

15.6 Technical expiry, account closure and refusal of optional marketing do not themselves establish a material breach. Account closure alone does not end valid lifetime licences.

16. Appeals

16.1 If you believe a licence or account restriction is wrong, email Contact@sizesynth.com with your account email, the affected app or decision reference and your explanation. Do not disclose passwords.

16.2 SizeSynth.com will review your explanation and relevant evidence and send the outcome and reasons within 14 calendar days of receiving your appeal, including correction where appropriate.

16.3 Relevant explanations, evidence, decisions and outcomes are retained under the shared Privacy Policy, as described in section 14.

16.4 An appeal does not automatically restore access or create a discretionary refund. It does not delay or remove a correction, refund or other remedy required by law, or prevent statutory complaints, data-rights requests or lawful dispute routes.

17. Warranties and Responsibility

17.1 Mandatory consumer rights, digital-content quality, fitness and description obligations, statutory repair, replacement, price reduction, refund and cancellation rights, and applicable remedies for damage to a device or other digital content remain unaffected. Early supply consent does not waive remedies for faulty content.

17.2 Subject to those mandatory protections, SizeSweep is supplied AS IS and AS AVAILABLE to the extent permitted by law. SizeSynth.com gives no additional warranty of uninterrupted or error-free operation or compatibility with every third-party system. This disclaimer does not vary the express product description, licence grant or support commitments.

17.3 You are responsible for suitable gain and monitoring levels, appropriate backups, and checking audio before delivery or publication. These responsibilities do not override our mandatory obligations or remedies.

17.4 SizeSweep does not guarantee a particular artistic result, income or commercial outcome. Your responsibility to hold the required rights and permissions in the material you use is set out in section 5.

18. Liability

18.1 Nothing in these Terms excludes, restricts or replaces the mandatory protections in clause 17.1. Nothing excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

18.2 Subject to clause 18.1, and to the extent lawful and fair in the circumstances, SizeSynth.com's total liability arising out of or relating to the affected SizeSweep licence entitlement is limited to the amount actually paid for that affected entitlement giving rise to the claim, as identified by the purchase record.

18.3 On the same basis, SizeSynth.com excludes liability for indirect or consequential loss and loss of business profits, business revenue, anticipated savings, business opportunity or business goodwill.

18.4 A consumer's recoverable foreseeable loss is not excluded merely by classifying it as indirect or consequential. The mandatory protections in this section override the warranty disclaimer, liability cap, loss exclusions and every other clause.

19. Changes and Existing Rights

19.1 These Terms govern the SizeSweep software supplied to you. SizeSynth.com may provide software updates and propose amended terms. Proposed terms will be provided before any new agreement.

19.2 Changes requiring agreement require a genuine affirmative choice. An ordinary launch, licence refresh or silence does not constitute acceptance of different terms.

19.3 Earlier accepted terms versions and existing genuine records will be preserved. Updates and amended terms must respect accrued rights, purchased computer capacity, the lifetime entitlement under the applicable accepted contract and mandatory remedies.

19.4 These Terms apply subject to the mandatory protections in clause 1.4 and section 18. No provision authorises a restriction or exclusion that applicable law does not permit.

20. Governing Law and Contact

20.1 SizeSweep is supplied and licensed by SizeSynth.com, based in Liverpool, United Kingdom. SizeSynth.com is operated by SizeSynth, trading as SizeSynth.com.

20.2 England and Wales law governs these Terms, subject to mandatory protections available under applicable law where a consumer habitually lives. Consumers retain access to courts and dispute routes provided by mandatory jurisdiction rules.

20.3 For business users, the courts of England and Wales have jurisdiction to the extent that agreement is lawful.
